Dimova Artists Ltd - Performer Privacy Notice

1. Who We Are

Dimova Artists Ltd (“Dimova Artists”, “we”, “our” or “us”) is a talent agency providing representation and work-finding services to performers. For the purposes of UK data-protection law, Dimova Artists Ltd is the data controller responsible for the personal data described in this notice.

2. Personal Data We Collect

We collect and process personal data that is reasonably necessary to represent performers and provide work-finding and related agency services. This may include:

  • Identity and contact information: full name, professional or stage name, postal address, email address, telephone number, date of birth and other information needed to identify or contact you.

  • Right-to-work and compliance information: information or documents needed to establish eligibility to work, together with relevant tax or National Insurance information where required for agency administration.

  • Professional profile information: CV, credits, training, skills, languages, accents, playing age, bases, measurements and other casting-relevant professional information.

  • Professional media: headshots, photographs, showreels, voice reels, self-tapes, audition materials and links to professional profiles such as Spotlight.

  • Availability and booking information: availability, auditions, meetings, options, bookings, contracts, correspondence, fees, usage, residuals and other engagement information.

  • Financial information: bank details and payment records where necessary to invoice, receive or remit professional earnings.

  • Communications: correspondence and records of communications between you and the Agency, and relevant communications with casting professionals, hirers and production companies.

Casting and employment opportunities can occasionally involve information revealing health or disability, racial or ethnic origin, or other information treated as special category data under UK GDPR. We will only process such information where it is genuinely necessary, lawful and proportionate for the relevant purpose, and will seek to minimise the amount collected.

3. How We Obtain Your Data

We may obtain personal data:

  • directly from you, including during onboarding and throughout representation;

  • from your authorised professional profiles and casting platforms, including Spotlight;

  • from casting directors, producers, production companies, hirers and other industry professionals in connection with auditions, bookings or professional enquiries;

  • from publicly available professional sources where reasonably necessary for representation; and

  • from professional advisers and service providers where relevant to contracts, payments, accounting or legal compliance.

 

4. Why We Use Your Data and Our Lawful Bases

We use personal data only where we have a lawful basis to do so. Depending on the activity, our principal bases are:

  • Contract: to enter into and perform our representation agreement with you, including managing your representation, making submissions, arranging auditions and meetings, negotiating engagements, administering bookings, invoicing and processing payments.

  • Legal obligation: to comply with applicable legal, regulatory, tax, accounting and record-keeping requirements.

  • Legitimate interests: to operate and administer the Agency, promote and present our roster to appropriate industry professionals, maintain professional records, protect our business and legal interests, and develop professional relationships, where those interests are not overridden by your rights and interests.

  • Consent: where consent is the appropriate lawful basis for a particular optional use. Where processing relies on consent, you may withdraw that consent at any time, without affecting processing already carried out lawfully.

Where special category data is processed, we will also identify and rely on an appropriate condition under Article 9 UK GDPR and any additional condition required by applicable UK data-protection law.

 

5. How We Use Professional Materials

As part of representation, we may use and share your approved professional name, biography, CV, credits, headshots, showreels, voice reels, Spotlight profile and other relevant professional materials to submit or pitch you for work and to identify you as a performer represented by Dimova Artists. This may include displaying approved professional materials on the Agency’s website or roster.

 

6. Who We Share Data With

Where reasonably necessary for representation or administration, relevant information may be shared with:

  • casting directors, casting associates, producers, directors, production companies, broadcasters, studios, theatres, advertising agencies, brands and other potential hirers;

  • casting platforms and professional industry databases, including Spotlight;

  • payment, banking, accounting and bookkeeping providers;

  • legal, tax and other professional advisers;

  • IT, cloud-storage, email, website and other service providers used to operate the Agency; and

  • public authorities, regulators, courts or law-enforcement bodies where disclosure is legally required.

We do not sell performers’ personal data to third parties.

 

7. International Transfers

The entertainment industry is international. Where appropriate for representation, we may submit or share professional materials with casting professionals, producers or hirers outside the United Kingdom. We may also use service providers that process information internationally. Where UK data-protection law requires safeguards for an international transfer, we will use an appropriate lawful transfer mechanism or otherwise ensure that the transfer is permitted by law.

 

8. If You Do Not Provide Information

Certain information is necessary for us to provide representation, submit you accurately for work, enter into or administer engagements, verify relevant work eligibility, or make payments. If required information is not provided, we may be unable to provide some or all of those services or to put you forward for particular opportunities.

 

9. Data Security

We take reasonable organisational and technical measures to protect personal data against unauthorised access, loss, misuse, alteration or disclosure. Access to performer information is limited to those who reasonably need it for representation, administration or legal compliance.

 

10. How Long We Keep Your Data

We keep personal data only for as long as reasonably necessary for the purpose for which it was collected and for applicable legal, accounting, tax, contractual or dispute-resolution requirements.

  • During representation, we retain the information reasonably needed to provide agency services.

  • After representation ends, professional materials that are no longer required will normally be removed or archived within a reasonable period, subject to legitimate administrative or legal needs.

  • Contracts, invoices, payment records, commission records and other financial or business records may be retained for up to 7 years after the relevant transaction or relationship ends where reasonably required for tax, accounting, contractual or legal purposes.

Different categories of information may therefore be retained for different periods.

 

11. Your Data-Protection Rights

Subject to the circumstances and exemptions provided by law, you may have the right to:

  • request access to personal data we hold about you;

  • ask us to correct inaccurate or incomplete personal data;

  • ask us to erase personal data in certain circumstances;

  • ask us to restrict processing in certain circumstances;

  • object to processing based on legitimate interests, including particular uses of your data;

  • receive certain personal data in a portable format and/or ask for it to be transferred where the right to data portability applies; and

  • withdraw consent at any time where we rely on consent.

12. Automated Decision-Making

Dimova Artists does not currently use solely automated decision-making or profiling that produces legal effects, or similarly significant effects, for performers.

 

13. Complaints

If you have a concern about how we use your personal data, please contact us first at tsv.dimova@gmail.com so that we can try to resolve it. You also have the right to complain to the UK Information Commissioner’s Office (ICO), the independent regulator for data protection in the United Kingdom.

14. Changes to This Notice

We may update this Privacy Notice from time to time to reflect changes in our practices, services or legal obligations. Where a change is material, we will take reasonable steps to bring the updated notice to represented performers’ attention.
